Professor Georg Nolte wirft in seinem Schreiben Berlin Academic Boycott vor, nicht genau recherchiert zu haben und ergreift Partei für die israelische Militärrichterschaft von Emanuel Gross.

In Bezug auf die wesentlichen Ausführungen von Professor Nolte sind folgende Punkte zur Kenntnis zu nehmen:

1.     Ein Ziel des akademischen Boykotts ist es, Informationen über institutionelle Kooperationen zwischen akademischen Einrichtungen und völkerrechtswidriger israelischer Staatspolitik bereitzustellen.[1]  Damit wird die Teilhabe akademischer Einrichtungen an der Mißachtung des internationalen Rechts deutlich gemacht sowie eine Positionierung dagegen gefordert.

Im vorliegenden Fall hat die Universität Haifa mit Emanuel Gross einen jahrzehntelangen Angehörigen der Militärjustiz (1972-1993) zu einem Mitglied ihrer Rechtsfakultät gemacht. Gross war nach Angaben seiner Universitätswebseite:

- Chief Judge, District Military Court, Southern Command, Israel Defence Force, 1987-1993

-  Deputy Chief Judge, District Military Court, Central Command, Israel Defence Force, 1980-1987

- Deputy District Military Attorney, Central Command, Israel Defence Force, 1972-1980

Mit der Berufung von Gross ist also eine institutionelle Verknüpfung von Universität und Militär geschaffen worden, die sich sowohl in der Rechtslehre und -forschung als auch in der verdeutlichten Diskriminierung von Personen, die nicht Militärdienstleistende sind, d. h. in erster Linie palästinensischer Studierender an der Universität Haifa niederschlägt.[2]

2.     Wer die Arbeit von Amnesty International kennt, weiß, dass Amnesty International (AI) in aller Regel keine Namen möglicher Menschenrechtsverletzer nennt. Daher darf sich Professor Nolte nicht darüber wundern, dass der Bericht Emanuel Gross nicht persönlich erwähnt, sondern „die israelische Militärgerichtsbarkeit, für die Herr Gross als deren ehemaliger Angehöriger in einem weiteren Sinn mitverant­wort­lich war“ kritisiert.

Im AI-Bericht „Israel and the Occupied Territories: The military justice system in the Occupied Territories: detention, interrogation and trial procedures” von 1991 heißt es:

“7. While judges in the military courts can consider whether a confession has been obtained [under] duress and are permitted to exclude any such confessions, they seem unwilling to exercise this option.“[3]

Damit beziehen sich die Vorwürfe von AI auch auf Emanuel Gross in seiner militärrichterlichen Funktion, eine namentliche Nennung ist hier nicht erforderlich. Der Bericht zeigt vielmehr ein System der Unterdrückung auf, an dem Emanuel Gross als Militärrichter mitgewirkt hat.

Desweiteren, und mit Bezug auf die Aufgaben der Richterschaft, heißt es im Amnesty International Bericht:

„6. The lack of safeguards in the system to protect against torture and ill-treatment, as well as the evidence accumulated over the years, lends credibility to these claims. The very existence of the legal power to hold suspects incommunicado for lengthy periods seems calculated to facilitate such treatment, as does the existence of an official government policy which sanctions not only ‘non-violent psychological pressure’, but also ‘a moderate measure of physical pressure’ during interrogation.“

Und weiter:

“10. While ‘quick trials’ appear to be utilized to avoid some of these problems, defendants are often tried without legal assistance as their lawyers are given insufficient notice of such trials, or none at all.“

Auch diesen Vorwürfen muss sich Emanuel Gross stellen, ohne dass seine Verantwortung namentlich gekennzeichnet wird.

Folter in Militärgefängnissen, Umgehungen des Rechts auf anwaltliche Verteidigung und Blitzurteile im Rahmen der Militärgerichtsbarkeit – diese Beispiele begründen eine negative Rechtsprechungspraxis, wobei Militärrichter die entscheidenden Funktionen in diesem System innehaben. Verständnis und Rechtfertigung derartiger völkerrechtswidrigen Praktiken ist ebenso unzulässig wie Proteste wie die von Berlin Academic Boycott als „nur zum Schein und oberflächlich gegen be­stimm­te Personen gerichtet“ darzustellen, wie dies Professor Nolte in seinem Schreiben tut.

Professor Nolte vermutet zudem, ohne jegliche Nachweise, dass sich Emanuel Gross mit Beendigung seiner Zeit als Richter vom Militär abgewandt habe. Weder Gross’ prominenter Auflistung seiner Positionen in der Militärjustiz auf der Universitätswebseite, noch anderweitigen Stellungnahmen können jedoch eine solche Abkehr von der Praxis der Militärjustiz entnommen werden.

3.     Die wiederholte Aufforderung Emanuel Gross nicht einzuladen, ist eine Aufforderung zum Boykott, die in Solidarität und Unterstützung von bereits bestehenden zivilgesellschaftlichen palästinensischen und internationalen Boykott-Aufrufen steht. Dabei handelt es sich nicht um einen individuellen Boykott, der die Redefreiheit einer einzelnen Person verletze, sondern um eine Form des institutionellen, den militärisch-wissenschaftlichen Institutionskomplex betreffenden Boykott.

Beide Aspekte sind in dem von Prof. Nolte aufgeworfenen Beispiel des US Supreme Court Richters Antonin Scalia nicht gegeben, weshalb der Vergleich unangebracht erscheint. Abschließend sei darauf hingewiesen, dass sich die Boykott-Bewegung gerade an die südafrikanische Boykott-Bewegung zu Apartheid-Zeiten anlehnt, die mit ihren Aufrufen das internationale Bewußtsein gegen Apartheid schärfen konnte und damit auch das Ende der Apartheid hervorbringen konnte.

Wir fordern Prof. Nolte dazu auf, seine Anschuldigungen, die Angaben von Berlin Academic Boycott seinen sachlich unrichtig und fehlerhaft, zurückzunehmen. Stattdessen wären seine eigenen Angaben, insbesondere bezüglich der Militärpraxis von Emanuel Gross mit Nachweisen auszustatten, die für alle einsehbar sind. Darüber, dass Gross ausschließlich über israelische Soldaten geurteilt habe, sind Nachweise ausstehend.

Auch können Professor Noltes Beiträge zum humanitären Recht sowie seine Einladungen palästinensischer Diplomaten, nicht hinwegtäuschen über die hier erhobenen gravierenden Vorwürfe gegen Emanuel Gross und seiner Einladung an die Humboldt-Universität zu Berlin.

Offener Brief an die Heinrich Böll Stiftung

Erst jetzt kündigt die Heinrich Böll Stiftung (HBS) an, dass ihr viel kritisiertes Filmfestival „Israel im Orient – Orient in Israel“ vom 28. – 31. 01. 2011 auch mit Unterstützung der Botschaft des Staates Israels finanziert wird.

Damit ist die HBS nicht nur dem Vorwurf ausgesetzt, dass sie mit dieser Filmreihe den Rassismus gegenüber jüdischen und nicht-jüdischen Araberinnen und Arabern in Israel mangels Benennung negiert und ausgrenzende und diskriminierende Stereotype und Politik, wie sie von der askenasischen politischen Klasse Israels gepflegt werden, fortschreibt. (siehe “Offener Brief Kritischer Jüdinnen, Juden und Israelis” vom 09.01.2011[i])

Nun muss sich die HBS auch vorwerfen lassen, sich klar für Propagandazwecke des israelischen Staates einspannen zu lassen.

Denn die Unterstützung von Filmfestivals, die die „Pluralität“ der israelischen Gesellschaft zeigen, folgt einem Regierungsprogramm, das die drei israelischen Ministerien Kultur, Tourismus und Auswärtiges 2005 beschlossen haben und das bekannt ist unter dem Namen: „Brand Israel – Hasbara“[ii]. Dem in weltweiten Umfragen zunehmend negativen Image Israels, das durch anhaltende Vorwürfe von Kriegsverbrechen und Verbrechen gegen die Menschheit geprägt ist, soll nun u. a. mit Filmfestivals entgegentreten werden. Kultur, Kunst und Pluralität des Landes sollen in den Vordergrund gerückt werden mit dem Ziel, mit Hilfe von Public-Relations-Agenturen „vom Konflikt mit den Palästinensern abzulenken“, so Ido Aharoni vom israelischen Außenministerium.

Aharoni beschreibt das Konzept zum Sieg im Kampf um die Darstellung („Winning the Battle of the Narrative“- Konzept) folgendermaßen: Es gehe darum, eine Verschiebung zu erwirken und Israel anders zu verkaufen, nämlich “weg vom Image eines Landes, das sich im Krieg und Konflikt befindet und hin zu einem Marken-Zeichen für positive Werte und Ideale, wie ‘Gestalter der Zukunft’, ‘pulsierende Vielfalt’ und ‘unternehmerische Begeisterung’.”

Die Heinrich Böll Stiftung kooperiert mit der Botschaft eines Staates, dessen Politik durch Besatzung, Kolonialisierung, Rassismus und Apartheid geprägt ist und sie lässt sich für die „mediale“ Kaschierung dieser Verhältnisse benutzen. In einer Zeit, in der die menschen- und völkerrechtswidrige Politik international unter Druck gerät wie selten zuvor, ist es unverständlich, warum die Heinrich Böll Stiftung ihren Auftrag zur Friedenspolitik selber ohne Not unterläuft und israelische Regierungspolitik schönfärbt und normalisiert.

Die palästinensische Zivilgesellschaft, die auf die Einhaltung des internationalen Rechts pocht, ist nicht willens, die israelische Politik der Verstöße gegen allgemein anerkannte Rechtsnormen hinzunehmen. Gemeinsam mit einer weltweiten zivil-gesellschaftlichen Bewegung fordert sie, dass akademische und kulturelle Projekte mit israelischer Staatsbeteiligung solange boykottiert werden, bis Israel die völker-rechtlichen Forderungen umsetzt:

“Alle Kulturprodukte, die von offizieller israelischer Seite in Auftrag gegeben werden (z.B. von Ministerien, Kommunen, Botschaften, Konsulaten, von staatlicher oder anderer öffentlicher Filmförderung etc.) sollten aus institutionellen Gründen boykottiert werden, weil sie vom israelischen Staat – oder einer ihrer mitverantwortlichen Institutionen – in Auftrag und deshalb auch finanziell gefördert werden, eigens um die staatliche Propaganda und die Bemühungen um ein anderes Image zu unterstützen, mit dem Ziel die israelische Besatzung oder andere Verletzungen der palästinensischen Rechte und des Völkerrechts herunterzuspielen, zu rechtfertigen, schönzufärben oder davon abzulenken.”[iii]

Die palästinensische Zivilgesellschaft fordert den Boykott als gewaltloses Mittel, wie er auch im Falle der Beendigung des Apartheidsystems in Südafrika erfolgreich war.

Den Solidaritätsaufforderungen folgend, möchten wir in diesem Sinne besonders die Teilnehmerinnen und Teilnehmer der Podiumsdiskussion am Montag, den 31. Januar 2011 bitten, ihre Teilnahme an dieser Diskussion zu überdenken und abzusagen.

Open letter to the Heinrich Boell Foundation

It is only now [two days before the showing] that the Heinrich Boell Foundation (HBS) announces that its much criticized Berlin film festival “Israel in the Orient – Orient in Israel”, January 28 to 31, 2011 is financed with the support of the Embassy of the State of Israel.

With its selection of movies, HBS is not only facing serious criticism for denying racism against Jewish and non-Jewish Arabs in Israel and for its lack of naming the exclusionary and discriminatory stereotypes and politics of Arabs, as maintained and perpetuated by the Askenasi political class of Israel (see the open letter by critical Jews and Israelis”, January 9, 2011[i]).

Now, HBS is also being confronted with the criticism of allowing itself to be used for obvious propaganda purposes for the state of Israel.

Supporting a film festival which is to show the “diversity” of Israeli society, follows a governmental program adopted by the three Israeli Ministries of Culture, Tourism and Foreign Affairs in 2005 and is known as the „Brand Israel – Hasbara“[ii].

The increasingly negative image of Israel, documented in several global surveys, strongly links Israel with persistent allegations of war crimes and crimes against humanity, and under Brand Israel is now to be countered with cultural events such as film festivals. Culture, arts and the diversity of Israel are now brought to the fore with the aim of using public relations agencies “to distract from the conflict with the Palestinians”, according to Ido Aharoni from Israel’s Ministry of Foreign Affairs.

Aharoni presented the concept, described in the “Winning the Battle of the Narrative” paper as repositioning “Israel away from an image of a country in a state of war and conflict to a brand which represents positive values and ideals like ‘building the future,’ ‘vibrant diversity’ and ‘entrepreneurial zeal.’”

The Heinrich Boell Foundation is cooperating with the embassy of a country whose policy is marked by occupation, colonialism, racism and apartheid, allowing itself to be used for a “media” cover-up of these crimes.

At a time when Israeli politics of violating human rights and international law have come under intense international pressure as never before, it is incomprehensible why the Heinrich Boell Foundation in its self-declared mission for peace undermines itself unnecessarily by whitewashing and normalizing Israeli government policy.

The Palestinian civil society, insisting on respect for international law, is not willing to accept the Israeli policy of violations of internationally acknowledged legal norms. Together with a global civil society movement, it calls for academic and cultural boycott of projects that are supported by the state of Israel until Israel implements international law:

“All cultural products commissioned by an official Israeli body (e.g., government ministry, municipality, embassy, consulate, state or other public film fund, etc.) deserve to be boycotted on institutional grounds, as they are commissioned and thus funded by the Israeli state — or any of its complicit institutions — specifically to help the state’s propaganda or “rebranding” efforts aimed at diluting, justifying, whitewashing or otherwise diverting attention from the Israeli occupation and other violations of Palestinian rights and international law.”[iii]

The Palestinian civil society calls for boycott as a non-violent means, the same means that successfully helped end the apartheid system in South Africa.

Following calls for solidarity, we urge the participants of the panel discussion on Monday, 31 January 2011 to reconsider and to cancel their participation.

We have learned that you are intending to give a concert in Israel with the No Smoking Orchestra, and we are writing to urge you to cancel the concert.

We know that you are making a film in Israel/Palestine, and we trust your political sense to guarantee that the reality of Palestinian daily life under occupation will be presented in all its horror, from the dispossession of their homes to the numerous discriminatory laws to which they are subjected, in an undemocratic system that can be described as apartheid.

By performing in Israel as an artist, on the other hand, you are offering your image to this country, and Israel will use your image to polish its own, to prove itself a representative of “civilized” culture and in this way to trivialize its crimes. It is absolutely certain that the state of Israel will view your concert as a form of political support, not merely a cultural event. And please don’t forget that the vast majority of Palestinians will not be able to hear, share, or experience the invigorating music of the No Smoking Orchestra, because they will not be permitted to travel to the site of your concert.

As a reaction to decades of oppression and to the failure of all attempts at peace, and taking inspiration from the South African struggle against apartheid, the Palestinian people have called on artists of conscience to join the movement of Boycott, Divestment, Sanctions (BDS) against Israel, in order to end the longest conflict in recent history. The BDS campaign asks for nothing more than the application of international law: ending the settlements, the occupation, and the blockade of Gaza, and dismantling the Wall; ending apartheid for the Palestinians of 1948 (the so-called “Israeli Arabs”); and the right of return for all refugees.

Things have changed as a result of this BDS call. Filmmakers and actors like Ken Loach, Jean-Luc Godard, and Meg Ryan, and musicians such as Elvis Costello, the Pixies, and Massive Attack, have publicly refused to play this game. To perform in Israel today is to make a political statement. We hope to count you among the artists joining the non-violent call to boycott Israel, and in this way helping to bring about equality of rights and justice in Palestine-Israel.

In response to the Palestinian call for international solidarity, please refuse to entertain Israeli apartheid.

• erklären sich bereit, den Boykott aufzubauen und zu stärken bis Palästinenser und Palästinenserinnen eine Lösung der derzeitigen Ungerechtigkeiten in Übereinkunft mit internationalem Recht und international anerkannten Menschenrechten erreichen.

Europa mit seinen Nationalstaaten und seinen integralen Institutionen spielt eine Schlüsselrolle in der Aufrechterhaltung der israelischen Besatzung palästinensischer Gebiete. Die Unterstützung dieser Politik wird gewährt trotz Israels wiederholten und vielfältig dokumentierten Verletzungen von Menschenrechten an Palästinensern: als Bürger und Bürgerinnen Israels, als unter israelischer Besatzung lebend und als Flüchtlinge. Dabei ignorieren und negieren europäische Institutionen den Respekt für Menschenrechte und Freiheiten, die die Grundpfeiler ihrer Erklärungen ausmachen. Daher ist es nunmehr an der europäischen Zivilgesellschaft, ihr Handeln in Übereinkunft mit diesen Prinzipien zu bringen.

Boykott, Disinvestition und Sanktionen (BDS) ist eine gewaltfreie und moralische Strategie, um Veränderung zu erzielen, wo dies nach jahrzehntelangen Programmen des „Brücken bauens“ mit dem Unterdrücker offensichtlich gescheitert ist. Der akademische und kulturelle Boykott ist angemessen, denn israelische akademische und kulturelle Institutionen sind Komplizen bei der massiven Beschränkung palästinensischer akademischer und kultureller Freiheiten – sie unterstützen direkt und indirekt die Regierungspolitik.

Der wichtige Beitrag von BDS, einschließlich des akademischen und kulturellen Boykotts, die Apartheid in Südafrika zu beenden, zeigt die potentielle Effektivität dieser Strategie.

Wir rufen alle europäisch wissenschaftlich und kulturell Tätigen auf, ihr nach ihrem besten Gewissen zu handeln und ihre Beziehungen, die sie zu israelischen Institutionen in ihrem Tätigkeitsfeld haben oder zu haben beabsichtigen, zu re-evaluieren und auf einen Prüfstein zu stellen.

Wir rufen diejenigen auf,  die Gerechtigkeit im Nahen  Osten und die weltweite Einhaltung des internationalen Rechts wünschen, lokale, regionale und nationale Strukturen zu schaffen, um den Boykott zu unterstützen.

Wir werden mit Rat und Tat bei der Gründung solcher Organisationen zur Seite stehen, um eine europaweite Koordination der akademischen und kulturellen Boykott-Aktivitäten zu erreichen.

Globale Begriffe im lokalen Kontext: Interdisziplinäre Rechtsforschung zum Spannungsdreieck Nation, Religion und Grundrechte / Global Concepts in Local Context: Socio-Legal Perspectives on Nation, Religion and Fundamental Rights“. Tel Aviv University, 19.-22. Dezember 2009

veranstaltet vom Law & Society Institute Berlin (LSI) HU Berlin, dem Minerva Center for Human Rights, Tel Aviv Universität und der Juristischen Fakultät der Tel Aviv Universität, möchten wir mit diesem Brief die aus unserer Sicht damit verbundenen Problematiken darlegen.

In einer umfassenden Studie der School of Oriental and African Studies (SOAS) vom Juli 2009 werden der Tel Aviv Universität (TAU) intensive, zweckgerichtete und offene institutionelle Verknüpfungen mit dem israelischen Militär nachgewiesen. Damit muß der TAU der Vorwurf gemacht werden, dass sie zentrale rechtliche, technologische und strategische Unterstützung leistet, die israeliche Besatzungspolitik aufrecht zu erhalten und zu erweitern. D.h. konkret, dass die TAU beteiligt ist an den diesjährigen tödlichen Angriffen auf den Gazastreifen, an der Aufrechterhaltung und Verteidigung der vom IGH festgestellt völkerrechtswidrigen Mauer, der Expansion von Siedlungen und dem erweiterten Netz von Checkpoints, die allesamt der palästinensischen Bevölkerung schwerste Menschenrechtsverletzungen zufügen. Diese Politik wird auch von Seiten der juristischen Fakultät der TAU unterstützt, die die Militär-Oberste Pnina Sharvit-Baruch, völkerrechtliche Beraterin der israelischen Armee und maßgeblich an der Entscheidung des Bombardements ziviler Infrastruktur in Gaza beteiligt, zur Professorin an der Rechtsfakultät der TAU ernannte.

Zudem werfen Studien u.a. des Alternative Information Center (2006), Adalah (2003), Human Rights Watch (2001) israelischen Bildungseinrichtungen, darunter auch TAU vor, bis heute an massiv diskriminierenden und rassistischen Ausgrenzungspraktiken festzuhalten, die es palästinensischen Israelis nur unter erschwerten Umständen ermöglichen, sich an der TAU einzuschreiben, geschweige denn Professuren zu erhalten.

Aus dem selbstformulierten Anspruch des LSI (Selbstdarstellung, Webseite Stand 26.8.09) und der Workshop-Ankündigung sowie aus der Notwendigkeit über den eigenen Umgang mit und die eigene Stellung im Recht (selbst-)kritisch nachzudenken, ergeben sich folgende Fragen im Hinblick auf die Umsetzbarkeit der Forschungsziele, die Wahl des Veranstaltungsortes und -kontexts sowie der involvierten Organisator_innen:

-       Kern des Forschungsinteresses seien gesellschaftliche Wirkungen von Rechtspraxen – dabei adressiert das LSI nicht die „Normalisierung“ rechtswidriger Praktiken durch ständige und systematische Übung sowie deren mehrfach festgestellten menschenrechtswidrigen Rechtscharakter. Auch lässt der Call for Papers keinen Anreiz erkennen, eine akademische Diskussion zur Beendigung rechtswidriger Praktiken zu initiieren. Wie kann der Anspruch auf qualitativ hochwertigen und durch umfassende Materialkenntnis gestützten Erkenntnisgewinn im Kontext des geplanten Workshops in Tel Aviv erhoben werden, wenn diese Prämissen unausgesprochen bleiben?

-       Das LSI erhebt den Anspruch, Forschenden „unabhängig von ihrer fachlichen Herkunft Raum für interdisziplinäre Arbeit und für transdisziplinäre Reflektion“ zu geben. In Anbetracht des geplanten Workshops in Tel Aviv ergibt sich die Frage, warum das LSI bereit ist, bestimmten Formen der (ethnischen) Herkunft die Möglichkeit der transdisziplinären Arbeit und Reflektion zu verweigern. Offenkundig ist es für palästinensische Forschende aus den von Israel besetzten Gebieten nicht möglich, Einreisegenehmigungen zu erhalten. Auch international Forschenden ist die Einreise nach Israel mehrfach verweigert worden, wenn diese Kritik an der israelischen Menschenrechtspolitik geäußert haben oder in einem arabischen oder islamischen Land geboren wurden oder einen arabischen oder islamischen Namen tragen. Wie ist ein solcher Ausschluss mit dem selbstformulierten Anspruch des LSI vereinbar?

-       Von welchen unweigerlichen inhaltlichen Verzerrungseffekten, die auf die oben genannte Teilnehmendenstruktur zurückzuführen sein werden, geht das LSI aus? Welche wissensgenealogischen Grundlagen für die Forschung zum Thema „Nation, Religion und Grundrechte“ werden damit ausgeschlossen? Welche Expertise ist damit dezidiert nicht vorhanden? Welche gelten damit als dominierend und akzeptiert?

-       Wie werden wissensgenealogische Grundlagen der eigenen Forschungsperspektiven der Institutionen reflektiert? Welche Expertise zeichnet die beteiligten Institutionen in Bezug auf das Workshop-Thema „Nation, Religion und Grundrechte“ aus? Welche möglichen Kritikpunkte ergeben sich thematisch?

-       Auf welcher Grundlage erfolgte die Auswahl der TAU als Kooperationspartnerin? Hat sich das LSI mit der Geschichte der TAU auseinandergesetzt?

TAU wird seit Jahren aufgefordert, ihre Vergangenheit anzuerkennen und ihrer zu gedenken. Dazu gehört, eine Informationsplakette anzubringen, die anerkennt, dass die Universität auf dem palästinensischen Dorf Sheikh Muwanis errichtet wurde, nachdem die Bewohner_innen 1948 durch die israelische Staatsgründung vertrieben wurden. Dieser Forderung ist TAU bis heute nicht nachgekommen.

-       Welche Berücksichtigung findet die von Wissenschaftler_innen weltweit formulierte Kritik an der – impliziten oder expliziten – Kooperation mit israelischen akademischen Einrichtungen und damit der Teilhabe an der Entrechtung von Palästinenser_innen? Wie positioniert sich das LSI zu palästinensischen, israelischen und internationalen Aufrufen, israelische akademische und kulturelle Einrichtungen zu boykottieren, die sich nicht explizit gegen die Verletzung internationalen Rechts und gegen Diskriminierungen positionieren? Welche Gründe gibt es aus Sicht des LSI diesem nicht zu folgen? Wie bewertet das LSI die Nicht-Teilnahme international ausgewiesener Wisssenschaftler_innen, die an dem international formierenden akademischen Boykotts teilnehmen? Von welchem Reputationsverlust muss das LSI im wissenschaftlich-kritischen Spektrum ausgehen?

-       Welche Offenheit der Diskussion verspricht sich das LSI, wenn sich Wissenschaftler_innen, die sich aus menschenrechtlicher und anti-rassistischer Besorgnis für den akademischen Boykott aussprechen, riskieren, je eine Anstellung zu erhalten, ihre derzeitige zu verlieren oder Rufmord ausgesetzt zu sein? Da dies aktuell Prof. Neve Gordon, Ben Gurion Universität betrifft, muss bezweifelt werden dürfen, dass israelische Universitäten als Bastionen liberal-kritischen Denkens und Orte des akademischen Austausches angesehen werden können.

Unvermeidbar ergibt sich aus diesen Fragen die Notwendigkeit einer Diskussion. Die Unterzeichnenden kommen zu dem Schluss, dass in Achtung und Abwägung aller Freiheiten, auch der akademischen, das fundamentale Recht auf Leben über alle Maßen überwiegt. Daher erfüllt es uns mit Sorge und Unverständnis, dass der erste internationale Workshop des LSI gemeinsam mit der Tel Aviv University (TAU) veranstaltet wird. Wir halten es für unhaltbar, institutionelle Verbindungen mit Universitäten einzugehen, die anhaltende Verstöße gegen das internationale Recht ermöglichen, unterstützen und legitimieren.

Wir erhoffen uns eine Stellungnahme zu o.g. Fragen, eine transparente Diskussion über die Problematiken eines solchen Workshops, die die gleiche Zugänglichkeit und Öffentlichkeit erfährt, wie der Call for Papers sowie den konsistenten Einsatz des LSI in Fragen von Anspruch und Wirklichkeit des (Menschen-)Rechts, welches seinem Selbstbildnis Genüge tut.

An Open Letter from PACBI

Dear Scorpions,

Occupied Ramallah, 28 September 2010 — The Palestinian Campaign for Academic and Cultural Boycott of Israel (PACBI) has learned from various sources that you are scheduled to perform in Tel Aviv on October 4, 2010.  Your performance in Israel was only recently announced on your official tour website. Prior to this, when we contacted your agents and lawyers to inquire about your performance we received ambiguous responses. Your now scheduled performance violates the appeal of the Palestinian Boycott, Divestment and Sanctions (BDS) movement [1] which urges people of conscience throughout the world to isolate Israel until it ends its colonial and apartheid oppression against the Palestinian people, as was done against the apartheid regime in South Africa. We urge you, as a band known for its commitment to support the “wind of change” and the falling of the Berlin Wall, not to perform in apartheid Israel that is building a far more cruel and illegal [2] wall on occupied Palestinian land.

We have also recently learned of previous concerts your group has performed in Israel [3] and the positions Klaus Meine took in the July 2006 war that Israel waged on Lebanon [4].  Your overall positions have made it imperative to call on you to take a morally consistent position in view of your past politics advocating justice and a dream for change.  We are also addressing you to call your attention to the growing international movement of Boycott, Divestment and Sanctions (BDS) against Israel.  We are hoping that you will heed the Palestinian call, and adhere to the international picket line supported by Israeli activists [5] and many international groups and prominent individuals [6].

Not listing the Israel concert on your website as part of your tour may be a slip or a disingenuous tactic to hide from criticism for playing in Israel and to avoid the boycott movement.  Regardless, now that the world knows you plan to entertain apartheid Israel, we ask you not to.

Origins of a Movement

Leading to the 2005 Palestinian civil society call for Boycott, Divestment, and Sanctions (BDS) [7], and inspired by the cultural boycott of apartheid South Africa, PACBI, supported by key unions and cultural groups, issued a call for the academic and cultural boycott of Israel in 2004, appealing to international artists to refuse to perform in Israel [8] or participate in events that serve to equate the occupier and the occupied [9] and thus promote the continuation of injustice.  This call is supported by devoted anti-racist activists around the world, from South African Archbishop Desmond Tutu to best-selling African-American author Alice Walker.  As Bishop Tutu recently noted in a historic statement unequivocally supporting the Palestinian boycott campaign against Israel:

I never tire of speaking about the very deep distress in my visits to the Holy Land; they remind me so much of what happened to us black people in South Africa. I have seen the humiliation of the Palestinians at checkpoints and roadblocks, suffering like we did when young white police officers prevented us from moving about. My heart aches. I say, ‘Why are our memories so short?’ Have our Jewish sisters and brothers forgotten their own previous humiliation? Have they forgotten the collective punishment, the home demolitions, in their own history so soon? … When we say ‘Never again!’ do we mean ‘Never again!’, or do we mean ‘Never again to us!’? [10]

Reconsider Your Past Positions

Many in the boycott movement are fans of your music and grew up singing and dancing to your songs.  The “Wind of Change,” in particular, gave us hope for a better world and future.  For this reason it came as a disappointment to learn that you have taken part in cultural propaganda efforts aimed to re-brand Israel, hiding its colonial and apartheid reality [11].  Specifically, your reference to Germany’s past should not serve as a pretext for silence or apathy towards Israel’s crimes, nor should it be used to equate criticism of Israel with anti-Semitism.  The lessons of Germany’s past should teach us all to reject all forms of racism, racial hatred and discrimination, to support the oppressed in the world lest they suffer from further oppressions by those in power, not to support a state that institutionalizes racism against its “non-Jewish” citizens.

Addressing this taboo issue, long-time Israel lobbyist and current University of Londonacademic Henry Siegman has recently written [12]:

A million and a half civilians have been forced to live in an open-air prison in inhuman conditions for over three years now, but unlike the Hitler years, they are not Jews but Palestinians. Their jailers, incredibly, are survivors of the Holocaust, or their descendants. Of course, the inmates of Gaza are not destined for gas chambers, as the Jews were, but they have been reduced to a debased and hopeless existence.

Fully 80% of Gaza’s population lives on the edge of malnutrition, depending on international charities for their daily nourishment. According to the UN and World Health authorities, Gaza’s children suffer from dramatically increased morbidity that will affect and shorten the lives of many of them. …

Particularly appalling is that this policy has been the source of amusement for some Israeli leaders, who according to Israeli press reports have jokingly described it as ‘putting Palestinians on a diet.’ That, too, is reminiscent of the Hitler years, when Jewish suffering amused the Nazis.

Given your positions, it is important that you understand why the BDS movement is calling on you to boycott performances in Israel and why your positions on peace and on Israel are misplaced.  Peace, as you know, is not a word that can be thrown about lightly, nor can it be achieved if those in power refuse to recognize the rights of the oppressed.

Some of the violations your position is supporting are:

- Israel’s brutal and unlawful military occupation of the West Bank and Gaza Strip.  Israelrestricts Palestinians’ freedom of movement and of speech; blocks access to lands, health care, and education; imprisons Palestinian leaders and human rights activists without charge or trial; and inflicts, on a daily basis, humiliation and violence at the more than 600 military checkpoints and roadblocks strangling the West Bank.  All the while, Israel fortifies its colonization of Palestinian lands by expanding the network of illegal, Jewish-only settlements.

- A growing system of Apartheid towards the Palestinian citizens of Israel, with laws and policies that deny Palestinian citizens the rights that their Jewish counterparts enjoy. These laws and policies affect education, land ownership, housing, employment, marriage, and all other aspects of people’s daily lives.

- Israel ethnic cleansing, in 1948, of more than 750,000 Palestinian people in order to form a Jewish state.  Since then, Israel has denied Palestinian refugees their internationally recognized right to return to their homes and their lands.  It also continues to expel people from their homes in Jerusalem and the Negev. Today, there are more than 7 million refugees, still struggling for their right to return.

Boycott Israel

Israel has used artists, musicians and other cultural workers as part of a campaign to BrandIsrael [13], a campaign that has been launched by the Israeli government and promoted by institutions throughout the country in order to whitewash Israel’s violations of international law and project a false image of normalcy.  But after Israel’s war of aggression against Gaza in December 2008 and January 2009, which left 1,400 Palestinians dead [14], predominantly civilians, and led the UN Goldstone Report to declare that Israel had committed war crimes [15], and after the flotilla massacre, many international artists have refused to conduct business as usual with a country that places itself above international standards.  Elvis Costello [16], Gil Scott Heron, Carlos Santana, Devendra Banhart [17], and the Pixies are but a few of the artists who have refused to perform in Israel in the past year.

As Holocaust survivor and co-author of the Universal Declaration of Human Rights Stephane Hessel wrote [18] after Israel’s deadly attack on the humanitarian relief Gaza-Bound Flotilla a few months ago:

The absence of meaningful action from governments to hold Israel accountable to international law leaves open one path for citizens of conscience: to take this responsibility upon themselves, as done against apartheid South Africa. Non-violent citizen-led initiatives, exemplified by the Flotilla and the various boycott and divestment campaigns around the world, present the most promising way to overcome the failure of world governments to stand up to Israel’s intransigence and lawless behavior.

The “Wind of Change” is upon us again. You can decide whether you wish to support “change” towards entrenching occupation and apartheid or change towards freedom, justice and upholding international law. If the latter, we hope you shall refuse to entertain Israeli apartheid!

Sehr geehrte Organisator/innen der Europan Law Student Association (ELSA),

wir beziehen uns auf die öffentliche Ankündigung für den am 12.08.2010 stattfindenden Vortrag des israelischen Botschafters zum Thema „Possible Reactions of a State of Law on Missile and Suicide Bombing Terror“ im Rahmen der International Law Conference on The Middle East Conflict vom 09. bis 14. August 2010 in Frankfurt/Oder.

In Übereinstimmung mit der internationalen Kampagne zum Boykott israelischer Institutionen, die sich nicht explizit gegen die völkerrechtswidrige Politik Israels positionieren, fordern wir Sie mit diesem Schreiben auf, den israelischen Botschafter auszuladen. Im Folgenden möchten wir unsere Forderung anhand der mit Ihrer Einladung verbundenen Problematik verdeutlichen.

Der Botschafter ist eingeladen, die Positionen eines Staates vorzutragen, der offenkundig, systematisch und weit verbreitet gegen geltendes Völkerrecht und gegen die Menschenrechte verstößt:

• ELSA lädt den Botschafter eines Staates ein, der eine seit 43 Jahren andauernde völkerrechtswidrige Besatzung zu verantworten hat. Israel verletzt Art. 53 IV. Genfer Konvention, indem es keine ausreichende medizinische und ernährende Versorgung der Bevölkerung der besetzten Gebiete sichert, bewegliches und unbewegliches Vermögen zerstört (Art. 55 IV. Genfer Konvention) und Land für Siedlungs-, Straßen- und Mauerbau konfisziert und annektiert ( Art. 49 IV Genfer Konvention und das IGH Mauergutachten). Der Botschafter vertritt zudem einen Staat, der bis heute das völkerrechtlich verbürgte Recht palästinensischer Flüchtlinge auf Rückkehr nicht anerkennt.

• Der Botschafter spricht für einen Staat, der sich nicht der Staatenverantwortlichkeit der Gaza Offensive 2008/2009 stellt. Hierbei ist insbesondere auf den Goldstone Report zu verweisen, der den israelischen Streifkräften vorwirft, während der Militäroperation in Gaza 2008/2009 gravierende Verstöße gegen die Genfer Konvention begangen zu haben.[2] Das umfasst zahlreiche, ernste Verstöße gegen internationales humanitäres Recht. Der Goldstone Report kommt zu dem Schluss, dass die israelischen Streitkräfte Handlungen begingen, die Kriegsverbrechen gleichkommen und möglicherweise Verbrechen gegen die Menschlichkeit darstellen.
• Der Botschafter legitimiert das Handeln eines Staates, der nicht-jüdische Bürgerinnen und Bürger weitreichend und systematisch diskriminiert. So halten beispielsweise alle israelische Universitäten an diskriminierenden und rassistischen Ausgrenzungspraktiken fest.[3] Damit werden vor allem palästinensische Bürger und Bürgerinnen Israels institutionell diskriminiert. Studierende, die dem israelischen Militär dienen, werden durch universitäre Programme privilegiert behandelt. Hierzu gehört auch die Tel Aviv University[4], deren ehemaliger Präsident und Rektor Yoram Dinstein ebenfalls als Redner von ELSA zur Konferenz eingeladen ist. Diskriminiert wird, wer nicht der israelischen Armee zugehörig ist, und damit nahezu die gesamte nicht-jüdische Bürgerschaft Israels.

Meinungsfreiheit ist für alle Vortragenden conditio sine qua non, und hat richtigerweise menschenrechtlichen Charakter. Aufgrund der Funktion des Redners als Staatsvertreters stellt sich die Frage, für welche Zwecke Meinungsfreiheit hier instrumentalisiert und missbraucht wird. Vor dem Hintergrund der oben dargestellten gravierenden völkerrechtlichen Verletzungen ist zu fragen, warum die European Law School Association mit dieser Einladung zur Normalisierung der Diskriminierungs- und Militärpolitiken des israelischen Staates beiträgt. Eine Konferenz zum Thema „Lösungsansätze im Nahostkonflikt“ kann Völker- und Menschenrecht als Referenz nicht umgehen. So erfordert eine Lösung des Konfliktes zum einen, dass sich die eingeladenen Redner und Rednerinnen das internationale Recht als Grundlage für die Debatte und politische Lösung nehmen.

Zum anderen ist zu fragen, welche Kompetenz und Legitimation der israelische Botschafter hinsichtlich rechtsstaatlicher Debatten besitzt – als Repräsentant eines Staates, in dem völkerrechtswidrige Verbrechen Normalität sind:

„Es ist eine Sache, die Genfer Konventionen und das humanitäre Völkerrecht zu kritisieren. Eine andere Sache ist es schon, diese Bestimmungen zu verletzen oder abzulehnen, […]. Einen entscheidenden Schritt weiter geht allerdings eine Regierung, die das humanitäre Völkerrecht und seine Verfechter zur Bedrohung für ihren Staat erklärt, die es systematisch zu bekämpfen gelte. Das aber ist die Haltung, die von der israelischen Regierung inzwischen fast routinemäßig vertreten wird. […]“[5]

Die Konferenz der ELSA ist kein Ort, der tatsächlich zu einer Lösung beitragen kann, vielmehr ist die Einladungsentscheidung an sich bereits die Prädisposition der Debatte. Sie spiegelt ein politisiertes Machtverhältnis und eine deutliche Positionierung der Veranstalter/innen jenseits des internationalen Rechts.

Der Boykott von akademischen Konferenzen, die das internationale Recht nicht als Maßstab nehmen, folgt dem Aufruf der überwiegenden Mehrheit der palästinensischen Zivilgesellschaft.[6] Die Tatsache, dass viele palästinensische Akademiker/innen an Ihrer Konferenz explizit nicht als Redner/innen teilnehmen, ist als Ausdruck des Protests ernst zu nehmen. In diesem Sinne ist eine öffentliche Positionierung der European Law School Association, auch gegenüber den Teilnehmenden und Gästen der Konferenz, ausstehend und notwendig.

Dear European Law Students’ Association Frankfurt (Oder),

It is with much regret that we learn that you fail to read the main critique of our letter:

A conference claiming to respect international law cannot host a speaker legitimizing widespread, ongoing and systematic breaches of international law.

The Envoy of the State of Israel, by his very function as state representative of a country accused of war crimes and crimes against humanity as put forth in the 2009 report of the UN Fact-Finding Mission led by Judge Richard Goldstone and a multitude of international, Palestinian and Israeli human rights NGOs, will only reiterate official state policy that is in utmost breach of international law. The Israeli State and his Envoy are publicly refusing responsibility according to the Goldstone Report, the ICJ advisory opinion on the illegality of the Wall. Instead their policy is consistent in

· Denial of its responsibility for the Nakba — in particular the waves of ethnic cleansing and dispossession that created the Palestinian refugee problem — and therefore refusal to accept the inalienable rights of the refugees and displaced stipulated in and protected by international law;

· Military occupation and colonization of the West Bank (including East Jerusalem) and Gaza since 1967, in violation of international law and UN resolutions;

· The entrenched system of racial discrimination and segregation against the Palestinian citizens of Israel, which resembles the defunct apartheid system in South Africa.

With your invitation to the Envoy of the State of Israel to your law school conference, you are offering a state representative a forum to ‘normalize’ this entire system of state violations of international law.

A last minute addition to the title of Israeli envoy’s conference title to “Possible Reactions of a State of Law on Missile and Suicide Bombing Terror and the Shared Responsibility to Ensure Peace in the Region” does not address the criticism raised in any way. Instead your title addition is aiding in constructing a false symmetry between occupier and occupier where by definition there can be no such symmetry.

You claim that ELSA is “a non-political association”. It is as exactly as such that we are expecting ELSA not to take political decision based on hegemonic contexts but on the basis of international law.

Instead, ELSA lends itself to be instrumentalized as a platform for state propaganda, from either side. Inviting a representative of the Palestinian General Delegation who bears no democratic legitimacy does not undo the wrongs of inviting the Envoy of the State of Israel.

Again, you are missing the point when you are aiming at a “balanced” view, and “a critical dispute and dialogue” as a way to solve the conflict. Conferences involving Palestinians and Israelis that promote “balance” between the “two sides” in presenting their respective narratives, as if on par, or are otherwise based on the false premise that the colonizers and the colonized, the oppressors and the oppressed, are equally responsible for the “conflict”, are intentionally deceptive, intellectually dishonest and morally reprehensible. Such events and projects, often seeking to encourage dialogue or “reconciliation between the two sides” without realizing the requirements of justice and international law, promote the ‘normalization’ of oppression and injustice. All such conferences, events and projects that bring Palestinians and Israelis together, unless framed within the explicit context of opposition to occupation and other forms of Israeli oppression of the Palestinians, do not contribute to any form of conflict solving. Instead, your reference point has to be the respect for international law which includes an end to Israel’s criminal impunity and decade long disregard for international law.

Referring to your audience as critical enough to discern the points raised, you are falsely redirecting your very own responsibility as conference organizers to your audience. It is ELSA Frankfurt/Oder that is responsible for the invitation policy of this conference, not your audience.

Background

Since Israel’s founding in 1948, and evermore since its occupation of the West-Bank, Golan Hights and Gaza in 1967, Israel has continuously deprived the Palestinian people of their universal human rights to life and liberty[1].  Along with the siege of Gaza, Israel is in violation of a number of UN resolutions, denies the right of return of Palestinian refugees expelled from their homes in 1948, and continues to build a separation wall and settlements in the West Bank. As another means of this repressive system the state erects hundreds of checkpoints in order to control residents of its Occupied Territories and East Jerusalem, and constructs segregated road systems between Palestinians and Jews. Additionally, the implementation of Israeli law is most of the time based upon racist supremacy and, thus, in conjunction with the above-mentioned facts, is similar  to what the international community witnessed for a long time in South African Apartheid[2].

The German hegemonic narrative is to unconditionally support Israel and its actions as well as to conflate anti-Zionism with anti-Semitism.  This narrative uses and instrumentalizes the tragedy of the Holocaust to silence those who speak out against human rights violations of Israeli politics and its international accomplices.

A Call For Boycott

Our campaign takes the South African struggle against apartheid as its inspiration. More importantly, it is an answer to the 2002 Palestinian civil society call for a comprehensive economic, cultural and academic boycott of Israel. In particular, we view the academic component of the Palestinian call to be of significant importance, because of a long and strong history of German-Israeli academic exchanges and collaborations. Academic knowledge is generated in order to fuse into and thus shape public discourse. In this vein, we would also like to emphasize the interdependency, complicity and genealogy of academic knowledge and colonization generally. Finally, as a human right, we fully endorse academic freedom, but we will not permit the exploitation of an academic environment for normalizing and legitimizing Israeli Apartheid.

Thus, we join and support the 2004 call by the Palestinian Campaign for the Academic and Cultural Boycott of Israel (PACBI). Our mission is based on the adoption of PACBI’s guidelines that calls on boycotting Israeli academic institutions by applying the following:

1. Refrain from participation in any form of academic and cultural cooperation, collaboration or joint projects with Israeli institutions;

2. Advocate a comprehensive boycott of Israeli institutions at the national and international levels, including suspension of all forms of funding and subsidies to these institutions;

3. Promote divestment and disinvestment from Israel by international academic institutions;

4. Work toward the condemnation of Israeli policies by pressing for resolutions to be adopted by academic, professional and cultural associations and organizations;

5. Support Palestinian academic and cultural institutions directly without requiring them to partner with Israeli counterparts as an explicit or implicit condition for such support.

We call on our colleagues and German institutions to boycott Israeli-German academic joint ventures until Israel meets its obligation to recognize the Palestinian people’s inalienable right to self-determination, and fully complies with the precepts of international law by:

1. Ending the occupation and colonization of all occupied lands, dismantling the Wall, and respecting the property rights of all dispossessed Palestinians or their families;

2. Recognizing the fundamental rights of the Palestinian citizens of Israel to full equality;

3. Respecting, protecting and promoting the rights of Palestinian refugees to return to their homes and properties as stipulated in UN resolution 194.

These three stipulations are meant as paramount preconditions for a comprehensive justice and viable peace in a prospective future.

The Goal And Future of The Movement

Only once these demands are met will a just solution be possible for ending Israel’s occupation and Apartheid policies.  Until then, we believe that boycott has proven successful, in instances like South Africa, India, and the United States civil rights era.  But most importantly, whilst being committed to a truly just and peaceful solution, it is a democratic means for members of an international civil society anywhere to promote dialogue and foster communication between Palestinians and Israelis.
